TERMS AND CONDITIONS
Our website www.dostchaliving.com is registered in the Netherlands and is registered with the Chamber of Commerce in Rotterdam under number 57234515. Below you will find the general terms and conditions of Dostcha Living.
1.1 These general terms and conditions apply to all legal relationships, with the exclusion of any other terms and conditions, in which Dostcha Living, established in Rotterdam, acts as supplier of products or advisor.
1.2 The other party (hereinafter referred to as: the customer) is the customer who purchases products from Dostcha Living. Dostcha Living does not accept any reservations for orders by the customer.
1.3 Dostcha Living reserves the right to unilaterally change these terms and conditions at any time and to inform the customer thereof. The customer acknowledges that Dostcha Living is authorized to unilaterally change these general terms and conditions and accepts to be bound by such amended general terms and conditions.
2. APPLICABILITY OF GENERAL TERMS AND CONDITIONS
2.1 Before the distance contract is concluded, the text of these general terms and conditions is made available to the customer. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that the general terms and conditions can be viewed on the Dostcha Living website.
2.2 If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the customer electronically in such a way that the customer can be stored in a simple manner on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that the general terms and conditions can be read electronically and that they will be sent free of charge at the request of the customer by electronic means or by other means.
3.1 Payment takes place on the website via various payment systems. The order will only be processed after the amount has been credited to the account number of Dostcha Living. It is not possible to pay afterwards. Dostcha Living reserves the ownership of all products to be delivered by it and, until full payment has been made.
3.2 In the event of cancellations, the order will be cancelled.
3.3 In the event of disagreement, the customer is responsible for the reimbursement of all costs, both judicial and extrajudicial, plus the administration costs incurred.
4.1 All prices are subject to typing errors.
4.2 The prices include VAT and shipping costs.
4.3 Dostcha Living reserves the right to change prices due to changes in exchange rates or changes in the global rug market.
4.4 Offers are subject to the availability of the products. Dostcha Living has the right to dissolve the agreement at any time.
4.5 Dostcha Living formulates its offers with due care, including price lists and other information. The customer cannot derive any rights from this. All images, drawings, data regarding weights, dimensions, colors, etc. are only approximate. Deviations from reality cannot give rise to compensation and/or dissolution.
5.1 Dostcha Living delivers worldwide.
5.2 Dostcha Living cannot guarantee the availability of all products. In the event of a shortage, the customer will be informed of this and the transferred amount will be refunded, or the agreement will be dissolved by Dostcha Living. The customer will be informed of this.
5.3 Dostcha Living tries to deliver the orders that are in stock within seven days and is entitled to fulfill the delivery in parts. All deliveries are handled by DHL or PostNL. It is not possible to send an order to a PO box address.
5.4 Standard packages are delivered on working days between 09.00 and 18.00. Delivery is always at the address specified by you.
5.5 For all custom-made rugs and rugs that are not in stock, we strive for a delivery time of between 2 and 8 weeks.
5.6 Delivery is only made to persons of 16 years or older.
5.7 Delivery only takes place on the ground floor, in case of a floor there must be a lift or adequate help for lifting it up, otherwise Dostcha Living reserves the right to deliver the goods on the ground floor.
6.1 Dostcha Living is not liable for damage caused by the purchase and/or use of delivered products.
6.2 Dostcha Living bears the risk for the delivery of products until the moment that it is delivered to the customer.
6.3 The terms mentioned are an indication and not as definitive terms. Dostcha Living is never liable for damage as a result of exceeding this delivery time.
7. EXCHANGE AND RETURN
7.1 During 14 working days after receipt of the order, the customer has the right to cancel the distance purchase without stating reasons, with the exception of the products as referred to in Article 7.3. In that case, however, the customer must first contact Dostcha Living, after which a return message is sent to the customer. It is the responsibility of the customer that the product arrives at Dostcha Living in undamaged condition. The product must be well packaged to prevent damage. The return is not completed until we have received and examined the returned goods. Once this has been completed, the amount of the order will be refunded to the customer's account within 30 days.
7.2 The costs of returning a product are for the account of the customer.
7.3 Items that have been created in accordance with the customer's specifications and/or have been personally accepted, such as but not limited to custom-made rugs, cannot be exchanged or returned.
8. SHIPPING COSTS
8.1 Dostcha Living calculates the shipping costs per order and not per ordered item.
9.1 The customer has a money back guarantee for 14 days. This does not apply to custom-made rugs. All other orders that are not to your liking can be returned within 14 days. The product must be in unaltered condition and must not have been used.
9.2 Immediately after delivery, the customer is obliged to thoroughly inspect the delivered goods for defects and to inform Dostcha Living in writing or by email if these are present. If the customer does not point out defects to Dostcha Living within 14 days after the day of delivery, the customer is deemed to agree with the condition in which the goods were delivered and any right to warranty lapses.
9.3 Dostcha Living grants a standard 1 year warranty with effect from the delivery date at the address given by the customer under normal use, provided that the washing instructions have been complied with.
10. LIABILITY FOR DAMAGES
10.1 Dostcha Living can only be held liable for damage that can be attributed to its intent or fault. The value of the liability will never exceed the sale price of the specific order.
10.2 Any liability of Dostcha Living for any other form of indirect damage is excluded. This includes any form of additional compensation, compensation for consequential damage and damage due to lost turnover or profit.
10.3 Circumstances that are regarded as force majeure and which are in any case not at the expense and risk of Dostcha Living are: strike, exclusion of workers, illness, import, export and/or transit ban, transport problems, failure to fulfill obligations by suppliers, production failures, etc.
11. CANCELLATION OF ORDERS
11.1 Custom-ordered rugs may not be canceled and returned.
12. CONFIDENTIALITY DATA
12.1 When placing an order and registering as a customer, the personal data of the customer is stored. Dostcha Living does this to complete the processing of the order correctly and on time and to provide the best service to the customer. Dostcha Living treats this information confidentially and will never provide the personal information to third parties.
13. DISCOUNT COUPONS
13.1 The discount coupon is valid in a certain period that is communicated. If the date of use has expired, no rights can be derived from the discount coupon.
13.2 The discount coupon is valid for the entire order.
13.3 When returning products, the amount remaining after the discount will be refunded to the customer's account number.
13.4 It is not possible to combine several discount coupons in one order.
13.5 Dostcha Living is not liable for loss, theft or damage to discount coupons.
14. COMPLAINTS PROCEDURE
14.1 Complaints about the implementation of the agreement must be submitted fully and clearly described to Dostcha Living within a reasonable time: welcome[@]dostchaliving.com, after the customer has discovered the defects.
15. APPLICABLE LAW / COMPETENT COURT
15.1 All agreements concluded by Dostcha Living and the offers made by Dostcha Living are exclusively governed by Dutch law.
15.2 Disputes between Dostcha Living and the customer will be adjudicated exclusively by the competent court in the District of Rotterdam.
